General travel and contract conditions for Discover-Travel

The general travel and contract conditions apply to the dynamic product DISCOVER of Air Prishtina AG.

The General Terms and Conditions (GTC) for flight reservations are an integral part of the general terms and conditions of travel and contract as follows. With the exception of this, is clause 3 (flight repurchase, passenger change and cancellation), which is replaced by points 4 and 6.

1. Completion of the travel contract

The travel booking or the travel registration can be made orally at Air Prishtina AG (in the travel agency of Air Prishtina AG), by telephone (on 0800 333 1 666), by email (servicecenter@airprishtina.com or kontakt@airprishtina.com) or via the Internet (www.airprishtina.com/discover).

1.2 The travel registration of the customer, which is based on the Internet tenders and brochures issued by Air Prishtina AG for each trip, is considered a binding offer to conclude a travel contract.

1.3 The travel contract is concluded with the receipt of the declaration of acceptance of Air Prishtina AG with the customer. This does not require a specific form.

1.4 Upon or immediately after conclusion of the contract, Air Prishtina AG will send a confirmation (by email) containing all essential information about the booked travel services. Air Prishtina AG uses the email address of the deposited customer at the time of booking.


2. Payment

2.1 Air Prishtina AG has concluded a bankruptcy insurance with "FAIR Reisegarant" to secure customer deposits.

2.2 After conclusion of the contract, the whole price of the travel price must be paid immediately. The travel price can be paid by the customer in the travel agency of Air Prishtina AG, by credit card (for online bookings), by bank transfer and if necessary by payment method paytastic or barzahlen.de in one of the acceptance points of the respective company.

2.3 In case of cancellation and rebooking, the fees become due immediately.

2.4 If the customer does not fully pay for the booked travel price regardless of the date specified, Air Prishtina AG reserves the right to withdraw from the travel contract and ask the customer for the amount fixed in point 4.1.

2.5 Request for travel execution exists only with full payment of the travel price.


3. Services and prices

3.1 Service descriptions are based exclusively on online tenders (www.airprishtina.com/discovery) and the confirmation information referring to them (see section 1.4). These are considered to be agreed.

3.2 However, Air Prishtina AG expressly reserves the right to declare a change in the terms of reference before signing the contract, informing the customer before booking. Any changes that become necessary after the termination of the contract are permitted only if the changes are not significant and do not affect the overall travel plan reserved. Reported flights and transfer times as well as airlines and aircraft may change.

3.3 The travel price depends on the travel time on which the selected travel date is based, as well as the departure airport and the relevant fare of the flight class.


4. Cancellation by the customer, revaluation, replacement of persons, early departure of travel.

4.1 The customer can cancel the trip at any time before departure. The decisive factor is the receipt of the withdrawal statement at Air Prishtina AG. It is clear that Air Prishtina AG's services (flight, hotel, travel guides, etc.) in an overwhelming inclusive vacation package. Single cancellations are not allowed. Due to these specific characteristics of the comprehensive tour (the "tour package"), the following cancellation fees apply:

- up to 30 days before departure 60%
- from 29 to 15 days before departure 70%
- from day 14 before departure 80%
- on departure day 95% of travel price.

The client has to prove that Air Prishtina AG did not have any damage or damage that is significantly lower than the required amount of disadvantage.

4.2 Until 24 hours before the start of the journey, the client may request a third party to enter into his / her rights and obligations under the travel contract (traveler's change). The additional costs incurred for this are determined by the relevant time at the time of the change. If the current price at the time of change of passengers for this itinerary is higher than it was at the time of the original reservation, the difference should be paid. However, the reimbursement of a possible absence is excluded.

4.3 After termination of the contract, redemption is only possible after the previous cancellation (according to 4.1) and a new reservation.

4.4 If the customer terminates the trip prematurely for reasons attributable to the customer, a claim for a pro rata refund of the travel price is excluded.


5. Travel insurance

Cancellation insurance is not included in the tournament price. Air Prishtina AG recommends filling the insurance for cancellation and repatriation.


6. Cancel and termination by Air Prishtina AG, minimum number of participants
.

6.1 Air Prishtina AG has the right to withdraw from the contract in the following cases prior to departure or to terminate the contract after the start of the journey:

- Up to 30 days prior to the start (Discover Macedonia) and up to 14 days prior to the start (Discover Kosovo) the minimum number of participants specified in the service description (www.airprishtina.com/discover) will not be reached.

- Unpredictable circumstances (war, natural disasters, etc.) Grant the right to cancel due to major violence.

- If the customer breaches the contract during the trip, Air Prishtina AG can not be expected to complete the travel contract.

6.2 The resignation from Air Prishtina will be immediately communicated to the client. The travel price paid by the customer will be refunded immediately. If the interruption was announced by Air Prishtina AG for personal reasons of the customer (breach of contract), Air Prishtina AG holds the right to the agreed travel price. Any additional costs for the return transportation will be carried by the customer.


7. Warranty and Remedy

7.1 If travel services are not provided in accordance with the contract, the customer may apply for compensation. If no legal remedy is provided within a reasonable period, the client is entitled to terminate the travel contract.

7.2 The notice of defect must be reported immediately to the tour guide on site. The tour guide has the right to accept the proclamation, recognition of claims in the event of a defect is only carried out by Air Prishtina AG.

7.3 If the complaint is incorrectly blamed, there is no reduction in the travel price. For the duration of a non-contractual provision of travel services, the customer may demand a corresponding reduction of the travel price (reduction).

7.4 The applicable statutory provisions apply.


8. Jurisdiction

8.1 Swiss law applies.

8.2 Address and registered office of Air Prishtina AG is Löwenstrasse 16, 8001 Zürich.

8.3 A client may sue Air Prishtina AG only at his headquarters.


9. Other

The inefficiency of the individual provisions of these travel conditions does not justify the ineffectiveness of travel conditions and / or travel contract otherwise.
